These Terms of Service ("Terms") govern your access to and use of the POURED EVENTS platform, including our website, web application, and related services (collectively, the "Platform"). The Platform is operated by 1001526972 Ontario Inc., operating as POURED EVENTS ("POURED," "we," "us," or "our"), an Ontario corporation.
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. What POURED Is
POURED is a platform for trade wine-tasting events. We provide software that lets event hosts ("Hosts") create and manage tasting events, present their wine catalogues, invite and register attendees and trade guests, and process event ticketing. Attendees can browse wines, save notes, and place wine orders that are fulfilled by the Host or the Host’s designated store.
POURED is a technology platform and facilitator. Except as expressly stated for ticketing (Section 5), POURED does not itself sell wine or alcohol. Wine and alcohol sales are made by the Host or the Host’s licensed store, who is the seller of those products.
2. Eligibility and Age Requirement
You must be at least 19 years of age (the legal drinking age in Ontario) to create an account or use the Platform. By using the Platform you represent and warrant that you are 19 or older. We may refuse, suspend, or terminate access to anyone who does not meet this requirement. The Platform is intended for use in Ontario, Canada.
3. Accounts
You may create one account used across roles (attendee, Host, exhibitor, collaborator). You are responsible for the accuracy of your information, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Roles and Permissions
- Hosts create and control events, manage catalogues and inventory, and may invite collaborators and grant them scoped permissions.
- Collaborators (co-hosts, coordinators, door staff, reps) act on a Host’s event within the permissions the Host grants them. Hosts are responsible for whom they invite and the access they grant.
- Reps may invite trade guests; exhibitors present their own wines and may access certain attendee information as described in our Privacy Policy.
- Attendees and trade guests browse, save notes, and place orders.
Hosts are responsible for their events and for their collaborators’ conduct on their events.
5. Ticketing, Payments, and Fees
Ticketing. Where an event charges for tickets, POURED processes ticket payments through our payment processor (Stripe).
Service fees. POURED charges a service fee on paid tickets, disclosed at the point of purchase and paid by the buyer in addition to the ticket price, except where waived (for example, free events). Fees may vary by event.
Wine orders. Wine orders placed through the Platform are fulfilled and sold by the Host or the Host’s store. POURED facilitates the ordering experience. Payment for wine orders is handled by the Host’s store or as otherwise arranged by the Host.
Taxes. Applicable taxes are the responsibility of the party making the relevant sale.
6. Refunds and Cancellations
Refunds and cancellations for tickets and orders are the responsibility of the Host. Each Host sets and administers the refund and cancellation policy for their own events. If you wish to request a refund or cancellation, you must contact the Host of the event.
Where POURED has processed a ticket payment, POURED may process a refund at the Host’s direction, but the decision to grant a refund and the responsibility for it rest with the Host.
7. Acceptable Use
You agree not to: use the Platform for any unlawful purpose; misrepresent your identity, age, or authority; attempt to gain unauthorized access; interfere with the Platform’s operation or security; scrape or harvest data; or use the Platform to facilitate the sale or supply of alcohol to anyone under the legal drinking age or in violation of applicable liquor laws. Hosts and exhibitors are responsible for complying with all laws applicable to their sale and supply of alcohol, including AGCO and Liquor Licence and Control Act requirements and licensing.
8. Host and Exhibitor Responsibilities
Hosts and exhibitors are solely responsible for: holding any licenses, permits, or authorizations required to sell or supply alcohol; the accuracy of their catalogues, pricing, and inventory; fulfilling orders; complying with all applicable laws (including alcohol, tax, and consumer-protection laws); and their own refund and cancellation policies.
9. Disclaimers and Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. POURED does not warrant that the Platform will be uninterrupted or error-free.
To the fullest extent permitted by law, POURED’s total liability arising out of or relating to the Platform is limited to the fees paid to POURED in the preceding twelve months. POURED is not liable for indirect, incidental, special, or consequential damages.
Indemnification. Hosts and exhibitors agree to indemnify and hold POURED harmless from claims, losses, damages, refunds, chargebacks, and liabilities arising from their events, their sale or supply of alcohol, their compliance failures, or their breach of these Terms.
10. Privacy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and share personal information in accordance with applicable Canadian privacy law.
11. Intellectual Property
The Platform and its content (excluding Host, exhibitor, and user content) are owned by POURED and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You retain rights to content you submit and grant POURED a license to use it to operate the Platform.
12. Changes to These Terms
We may update these Terms. Material changes will be communicated (for example, by requiring renewed acceptance). Continued use after changes take effect constitutes acceptance. The "Last updated" date reflects the current version.
13. Termination
We may suspend or terminate access for violation of these Terms or as needed to comply with law. You may stop using the Platform at any time.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
